SAMSUNG GEARUP PRIVACY NOTICE EFFECTIVE DATE: [APRIL 1ST, 2022] We at HARMAN Connected Services, Inc., along with our affiliates and subsidiaries (collectively, "Harman," "we," "us," "our") respect your concerns about privacy. This Samsung GearUP Privacy Notice (“Privacy Notice”) explains the types of information collected through the Samsung GearUP application which will be further referred as ("GearUP"), how we may use the information, with whom we may share it and the choices available to you regarding our use of the information. We also describe the measures we take to safeguard the information and tell you how to contact us about our privacy practices. This Privacy Notice applies only to the information we collect through GearUP. 1. INFORMATION WE OBTAIN The types of personal information we may obtain through GearUP include: • information used to create your account to access GearUP, such as username and password; • health and wellness-related information, including accelerometer, heartrate, activity, step count and sleep data; and • information about your device, such as device model, OS version, device configurations and settings, mobile network operator and settings, IP address, device identifiers, location and other unique identifiers. In addition, we may obtain information about how, when and for how long you use GearUP. We also may collect other information about you, your device and your use of GearUP in ways that we describe to you at the time of collection or otherwise with your consent. How GearUp uses users’ location information Users see a request prompted by your device for permission to share your location information when you try to pair with GearUp, which includes location data collected by nearby wifi signals or LTE if available in the watch. As a default, for the best service available the app asks you to turn on location services "Allow only while using the app." We use location data to find User that is in the Geo-Fence of the organization and help the admin users to track the users on field. We also use it to display Last location and Location history, to understand and identify the user during any kind of emergency, and safety of the users. You can manage your location settings in your device's location preferences, unless your device is managed or controlled by your employer or organization that issued the device to you. In such cases, the user settings may not be accessible because they are controlled by your employer or organization via a Mobile Device Management (MDM) software, such as Samsung Knox Manger. Location data (Admin and Watch User): We collect Admins and Watch users’ precise or approximate location data, to enable users’ tracking and safety features and enhance use of our apps, to prevent and to satisfy legal requirements. GearUp collects this data when the GearUp app is running in the foreground (app open and on-screen) or background (app open but not on-screen) of users’ device. We collect such data from users’ watch devices if they enable us to do so. (See below for information on how users can enable location data collection). Users may enable GearUp to share real-time location data from their watch devices with emergency police, fire, and ambulance services. Such data may include approximate location at the time the emergency call was placed. Admin and Watch users’ may use the GearUp apps without enabling GearUp to collect precise location data from their watch devices. However, this may affect features in the GearUp apps. For example, a user who has not enabled location data collection will not be able to be tracked if SOS alert is raised in case of emergency. In addition, the location data collected from a user will be linked to the organization account, including for purposes of tracking user and user safety. GearUp performs the above activities, including the collection and use of location data for purposes of these activities, on the grounds that they are necessary to fulfill our obligations to users under our Terms of Use or other agreements with users. 2. HOW WE USE THE INFORMATION WE OBTAIN We may use the information we obtain through GearUP to: • provide you with GearUP’s features and services; • identify you and authenticate you so that you may use GearUP. • with your consent provide our partners ("Partners") with information concerning your health and wellness, including your fatigue levels and location; • respond to your requests and inquiries; • operate, evaluate and improve our business (including developing new products; enhancing and improving GearUP and our products; managing our communications; analyzing GearUP, our products and customer base; conducting market research; performing data analytics; and performing accounting, auditing and other internal functions); • protect against, identify and prevent fraud and other criminal activity, claims and other liabilities; and comply with and enforce applicable legal requirements, relevant industry standards and our policies, including the GearUP Terms of Service. 3. INFORMATION SHARING With your consent, we may share the information described in this Notice with our Partners. Our Partners and their affiliates have their own privacy notices and practices that relate to their use of information collected through GearUP, which we strongly suggest you review. We also may share your personal information with our subsidiaries and affiliates and with third-party service providers who perform services for us. We do not authorize our subsidiaries and affiliates or our third-party service providers to use or disclose the information except as necessary to perform services on our behalf or to comply with legal requirements. We may also disclose your information (1) if we are required to do so by law or legal process (such as a court order or subpoena); (2) in response to requests by government agencies, such as law enforcement authorities; (3) to establish, exercise or defend our legal rights; (4) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (5) in connection with an investigation of suspected or actual illegal activity; (6) in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, reorganization, dissolution or liquidation); or (7) otherwise with your consent. 4. LINKS TO OTHER WEBSITES, APPS AND FEATURES GearUP may provide links to other websites, apps and features for your convenience and information. These websites, apps and features may operate independently from us and may have their own privacy notices or policies, which we strongly suggest you review. To the extent any linked website, app or feature is not owned or controlled by us, we are not responsible for its content, any use of the website, app or feature, or the privacy practices of the website, app or feature. 5. HOW WE PROTECT PERSONAL INFORMATION We maintain administrative, technical and physical safeguards designed to protect the personal information we obtain against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. 6. CHILDREN’S PERSONAL INFORMATION GearUP is designed for a general audience and is not directed to children under the age of 13. Harman does not knowingly collect or solicit personal information from children under the age of 13 through GearUP. If we learn that we have collected personal information from a child under the age of 13, we will promptly delete that information. If you believe that a child under the age of 13 may have provided us with personal information, please contact us as specified in the "How to Contact Us" section of this Privacy Notice. 7. UPDATES TO THIS PRIVACY NOTICE This Privacy Notice may be updated periodically and without prior notice to you to reflect changes in our privacy practices with respect to GearUP. We will indicate at the top of the Notice when it was most recently updated. 8.
